General
As we stated previously in our General Terms and Conditions, the Platform provides a personalized subscription service that allows Users to access our specialized content (“Specialized content”).
The Specialized content means learning services, and/or any other spaces, services, videos, applications, content related to specific area of aesthetic medicine.
If you want to use our service, you must meet certain criteria, as follows:
- Prove you are licensed aesthetic healthcare professional (e.g., dermatologists, plastic surgeons, aesthetic physicians, dentists, ophthalmologists, nurses etc.);
- Register an account on the Platform;
- Registered, valid, accepted method of payment;
Provide, upon request, documentation proving your professional status and any other information required for verification. The Platform reserves the right to request additional documentation and to accept or reject any application at its sole discretion.
By accepting these Subscription Terms, you represent that you understand and agree to the foregoing. We offer a range of subscription plans with different prices, conditions, and limitations. You may find specific details of each subscription plan (“Subscription plan”) in our pricing section.
Plans
Details of current Subscription plans, including included classes, duration, and pricing, are available on the Platform and may be updated from time to time.
Your subscription becomes active at the moment payment is successfully processed.
Any changes to pricing will apply only after prior notice in accordance with applicable law and will take effect from your next billing cycle.
Classes
As part of the specific Subscription plan, you will purchase a stated number of classes.
You may check the remaining balance of your classes by visiting your account.
All classes are valid for a limited time as described in the applicable Subscription plan.
The classes expire immediately upon the cancellation or termination of your Subscription unless used prior to cancellation or termination. The classes have no cash value or any other value outside of the Platform and are not redeemable for cash. For the avoidance of doubt, the classes do not operate or serve as stored value facilities in any way. You may not trade, gift or otherwise exchange your classes.
If a class requires scheduling, you must comply with any scheduling and cancellation rules published on the Platform. Failure to attend or late cancellation may result in forfeiture of the class.
Billing
Following the concrete Subscription plan, you shall pay the applicable monthly (billed every four weeks), quarterly (billed every three months) or annual (billed every 364 days) fee (“Subscription Fee”). Unless you cancel your subscription before the end of the applicable subscription period, you authorize the Platform to charge the Subscription Fees for the next billing cycle to your Payment Method. If funds are insufficient, we will try renewing your subscription for up to thirty (30) days until funds are available.
The Subscription Fee and any other charges you may incur in connection with your use of the Services, such as taxes and transaction fees, will be charged to your Payment Method on the specific billing date indicated on your account “Settings” page. The length of your billing cycle will depend on your chosen Subscription plan.
In order to ensure that you do not experience any interruption in your subscription process, your subscription will automatically renew for additional periods of the same duration, unless you cancel your subscription at least seven (7) days before the end of the applicable billing cycle.
Payment methods available on the Platform are as follows:
- Visa/Mastercard;
- PayPal;
- Apple Pay;
- Google Pay;
To use the Services on the Platform you must provide one or more Payment Methods. You authorize the Platform to charge any Payment Method associated with your account in case your primary Payment Method is declined or no longer available to us for payment of your Subscription Fee. You remain responsible for any uncollected amounts. If payment is not successfully settled due to expiration, insufficient funds, or otherwise, and you do not cancel your subscription, we may suspend your access to the Services until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to processing your Payment Method.
You can update/ change your Payment Methods, at any moment, by going to your account’s “Settings” page and following the instructions for changing or removing your Payment Method. Following any update, you authorize us to continue to charge the applicable Payment Method(s).
Cancellation
You may cancel your subscription at any time before your next billing date by going to your account’s “Settings” page and following the instructions for cancellation.
The unused classes included under your chosen Subscription plan will expire at the end of your billing cycle. You will, however, still be able to access and use our services to take classes that were scheduled before the end of your current subscription period.
Refunds
In general, payments are non-refundable, and we do not provide refunds for any partial subscription periods or unused classes.
The Platform may provide a refund only in the event no classes have been used during your current subscription period, provided the payment was made less than seven (7) days ago.
If there are extenuating circumstances that cause you to miss the class or cancel it at short notice, these refunds can be made at the Platform’s discretion, but the Platform is not obligated to do so.
The Platform is not responsible for any fees charged by banks or third-party payment processors and will not cover them when initiating a refund.
If you choose and get a refund option, its speed and the availability of refunded funds in your bank account will depend solely on your bank’s terms and policies. The exact refund amount will depend on the EUR to your payment method’s currency exchange rate valid on the date the refund is initiated.
No refund will be issued if you have lost and/or forgotten your login credentials (username and passwords), which has resulted in the loss of data, temporary loss of access to your account, or any other inconveniences for you.
No refund will be issued if you have lost connection due to the absence of Internet access, factory reset, or updates.
If you decide to delete your account, your remaining balance will expire. In case the Platform suspends or terminates your account due to a breach of any of our policies, you understand and agree that you will receive no refund or compensation for any unused balance or scheduled classes.
General
In registering for an account, you agree to provide us with accurate, complete, and updated information and must not create an account for fraudulent or misleading purposes.
Your username and password are for your personal use only and should be kept confidential. You are solely responsible for any activity on your account and for maintaining the confidentiality and security of your password. We are not liable for any acts or omissions by you in connection with your account.
You agree to use the Services and the Platform in accordance with all applicable laws, rules, and regulations, or other restrictions on the use of the service therein. You agree not to reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorized in these Subscription Terms) information and materials contained within or obtained from or through the Services.
The Services are for your personal and non-commercial use only. Subject to your compliance with the terms and conditions outlined herein and General Terms of Service, we grant you a limited, non-exclusive, non-transferable, non-assignable right to access the Services during the period of your subscription. This access shall remain in effect unless and until terminated by you or the Platform. Except for the foregoing, no right, title or interest shall be transferred to you.
Responsibility
We may terminate or suspend your access to the Services and to the Platform at any time if we suspect (i) a breach of these Subscription Terms; (ii) sexual or other unwelcome harassment, threats or intimidation; (iii) illegal or fraudulent activities on your behalf.
Where reasonable, we will notify you of such suspension or termination; however, immediate action without notice may be taken where necessary to prevent harm or comply with legal obligations.
Liability
To the maximum extent permitted by applicable law, the Platform shall not be liable to any User or any other person or entity for any direct, indirect, special, incidental, consequential, or exemplary damages (including, but not limited to, property damage or monetary loss, loss of profit or anticipated savings, loss of business, contracts, contacts, goodwill, reputation and any loss that may arise from interruption of the business, loss of data, loss of use, or costs of obtaining substitute goods or services) arising out of the use, inability to use, unauthorized access to or use or misuse of the Platform and of the Services or any information or materials obtained in relation to the Platform and to the Services, whether based upon warranty, contract, tort (including negligence), or, otherwise, even if has been advised of the possibility of such damages or losses.
Users are solely responsible for all professional decisions. The Platform does not provide medical advice and shall have no responsibility or liability for any outcomes of procedures performed by Users.
You agree that the Platform’s total cumulative liability in connection with these Subscription Terms or the Services whether in contract, tort, or otherwise, shall not exceed the amounts you paid in Subscription Fees in the then-prior one (1) month.
Other
These Subscription Terms shall be governed by and construed in accordance with the laws of the European Union.
The Platform may suggest amendments or modifications to these Subscription Terms at any time by posting a revised version on the https://elevate-mastery.com/ website. The Platform will provide you with notice whenever such amendments are material.
The Platform shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, labor conditions, governmental actions, internet or telecommunications failures, or power outages.
You may not assign or transfer your rights or obligations under these Subscription Terms without the prior written consent of the Platform. The Platform may assign its rights and obligations, in whole or in part, to an affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of assets.
If any provision of these Subscription Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law. The failure of the Platform to enforce any right or provision will not constitute a waiver of such right or provision.
These Subscription Terms, together with the General Terms and Conditions and any policies referenced herein, constitute the entire agreement between you and the Platform regarding the Services and supersede any prior or contemporaneous agreements on the subject matter.
